Waiting twelve years for reckless delivery, Justice and Paula life will never be the same
The Sao Marcos Hospital in Braga is no longer. It is now torn down in the local health department. There Paulo Caesar was born there, almost 20 years ago, after his mother’s unforgettable labor.
Paula was admitted to the hospital at five o’clock in the afternoon. It gave a break from the bag, but still without contractions. Medications were administered to stimulate delivery and connected to the heart monitor. According to her mother, she spent the night without any companion. The next morning only one midwife appeared at eight o’clock.
The hospital report indicates that bradycardia has an emergency cesarean section – the fetus has a dangerous low heart rate. Paulo was born with Seser 5, which is a sign of sucking pH.
It was hospitalized for 15 days. After the discharge, the mother asked the pediatrician to attend childbirth to continue with the baby in the following consultations. For months, they failed in an appointment.
Diagnosis: Severe cerebral palsy
In the face of complaints, the answer is always the same: physiotherapy to strengthen the muscles. Only in six months, when he was sent to a separate center, Paula knew the diagnosis: severe cerebral palsy. The Paulo cesar is also suffering from epilepsy. Don’t talk, don’t walk and wear diapers.
Family life has changed serious. Paula stopped working. A few years later he had a healthy second child. But the marriage was unable to resist. Divorced Paula had to start. He got up at four o’clock in the morning to organize his children’s day. He took the eldest to his grandparents home, where he was until he came to school. Even the youngest should not wake up with his grandparents.
He worked in the upholstery factory. When I return the house, the tasks of the ritual are still: prepare dining boxes, clothes, lunch.
2010: Paula develops with a complaint
He always believed that all this started at the birth. Therefore, in 2010, he came up with a complaint against the hospital, the midwife and the pediatrician.
Initially, medical expertise was requested. Cardiac registrations of delivery were sent to Koimbra, but the expert felt that they were unreadable. For ten years, the process stopped.
Only in 2020, after SIC reportThere are progresses. The specialist was finally summoned to the court to analyze the registrations on the site. A year later, Braga’s administration and tax court confirmed medical negligence.
The regional health administration has appealed, but the Supreme Court continued the punishment: Palo’s issues were caused by lack of assistance in delivery.
Compensation exceeds 1 million and 800 thousand euros. The Northern Regional Health Administration has been ordered to pay property and non -profile damage, higher interest and court expenses.
The Superior Council of Administrative and Tax Courts, who contacted SIC, said that actions are usually three years. It continued twelve.
