The Bombay High Court condemned the police and said that the 50 -year director of the anchor committee, Hemang Shah, had been arrested as illegal. The court said in his ruling that there was no need to detain him in the case ‘Josh and excitement’. The court also insisted that the purpose of his arrest was to restore the controversial amount.
The court expressed a strong opinion on the behavior of the police in this entire case, saying that the complaint was “the biggest urgency” at 2:14 pm after May 14 and the Look Out Circular (LOC) is issued on the same day.
Hemang Shah was detained on the basis of LOC on the basis of LOC on Mascott at Delhi Airport on May 17. The complaint was lodged at his elder brother Mehul Shah Malabar Hill Police Station, in which allegations were made. Hemung Shah Bombay filed a petition in the High Court against the illegal arrest. Senior lawyers Ravi Prakash, Munaf Virji, Aditya Diwan, Debopri Banik, and Sagar Shetty (Amr Law and Hiriduraj Singh) have urged the petitioner. The petition suggested that there was a financial dispute between Hemung and his older brother and father, which sought to solve the mediation. When Hemung was arrested, he approached his brother Hemang’s wife and pressured the economic crimes branch to come to the office of economic crimes. Along with the petition, some of the chats related to it were also presented in court.
The court has confirmed that after observing these chats, “the purpose of detention of the petitioner was recovered by the arbitration.” Hemang said hemung was detained at the Delhi airport at 5:30 pm on May 17 and was delivered in front of the magistrate at 10:45 pm on May 18 – that is, for more than 24 hours, it was wrong. In addition, he was given the reason for the arrest, but there was nothing to be reported to a relative or friend. His legal committee says this is a strategic pressure.
Eow officials and Hemang Shah reached Mumbai on May 18 at 10:30 am and after the initial hearing, the government was arrested at 7:30 pm and prepared in court at 10:45 pm. He also said that the arrest was reported to Hemang’s father.
However, the court dismissed the state’s argument, claiming that hemung’s father was a complainant in this case, saying it was “surprising and shock”. The court’s decision has once again raised serious questions about the role of the Mumbai police in economic matters.
