The rule for work in commercial on Sundays comes into force

The new control of the Ministry of Labor and Employment changes working hours on Sundays and holidays in the commercial sector. The main change is required in the Collective Labor Agreement (CCT) so that various commercial activities can work these days, except for free markets.

The measure comes into effect from July 1 after postponing a series.

The work in trade these days has not been banned, as it has been controlled by a law for 25 years. The government ordinance changes the previous rule published in the management of former President Zair Bolsonoro, which allows work on Sundays and holidays through a general agreement between bosses and employees, which is considered illegal.

With the new ordinance, the agreement should be signed by mass meetings. They have workers on the one hand, the owner union, on the other hand. It provides the standard of respecting municipal law on this issue that is not necessary.

Ordinance number 3,665 was published on November 13, 2023. Its creation has been inspiring by complaints of trade unions, which is disrespectful for the law to guarantee the right of commercial workers to negotiate on working conditions on Sundays and holidays.

The mentioned goal is to strengthen the spirit of mass bargaining.

The complaint

The Federal government tried to implement the action in 2023, but has been postponed many times due to dissatisfaction with the owners arising by this proposal. In addition to the commercial sector, it is connected to the sector from members of Parliament, which was considered a setback.

Under the new clause, Sundays and holidays in the commercial sector need to be allowed, there must be a signed agreement by the mass agreement. They justify specific regulations for each sector or class in trade.
